Terms of Use

These Terms of Use ("Terms") govern your use of the Zikporx Network app for iPhone and iPad (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or internal business purposes, on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

You may not copy, modify, distribute, sell or lease the App; reverse engineer or attempt to extract its source code, except where the law allows; or remove any proprietary notices.

2. Acceptable use — scan responsibly

The App includes network diagnostic tools, including ping, traceroute, a TCP port scanner, a local network (LAN) scanner and service discovery. You agree to use these tools only on networks, devices and systems that you own or have explicit permission to test.

You agree not to use the App to:

• scan, probe or test any system without authorization;
• disrupt, overload or interfere with any network, service or device;
• break any law or regulation, including computer misuse laws such as the U.S. Computer Fraud and Abuse Act, or the terms of your Internet service provider or the network you are using; or
• harass anyone or violate the rights of others.

You alone are responsible for how you use the App and for the results of that use.

3. Third-party data and services

Much of the information in the App comes from third-party services, such as DNS resolvers, IP information providers, RIPE NCC, domain and IP registries (RDAP), and reputation and blocklist providers. We do not control these services, and:

• we do not guarantee that their information is accurate, complete or current;
• reputation and blocklist results reflect only what those third parties report. They are not our judgment of any person, domain or IP address;
• these services may change, limit or stop providing information at any time, which may affect the App; and
• your use of these services may also be subject to their own terms.

4. Your own API keys

If you enter your own key or token for a third-party service, such as a Spamhaus DQS key or an ipinfo.io token, you are responsible for following that provider's terms, including any fair-use, non-commercial or volume limits. Keys are stored only on your device.

5. Monitoring is best-effort

Monitors run when the App is open and when iOS allows background activity. iOS controls how often that happens. Monitoring is not a guaranteed or continuous service and must not be relied on for critical, safety or business-essential alerts.

6. No professional advice

The App provides technical information for general purposes. It is not legal, security or professional advice. Consult a qualified professional before making decisions based on its results.

7. Intellectual property

The App, including its design, code, graphics and the Zikporx name and logos, is owned by TechTunerLife LLC and protected by intellectual property laws. These Terms do not transfer any ownership to you.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ITS RESULTS WILL BE ACCURATE OR RELIABLE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TECHTUNERLIFE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $50.

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless TechTunerLife LLC from any claims, damages or expenses, including reasonable attorneys' fees, arising from your misuse of the App or your violation of these Terms or of any law, including any unauthorized scanning or testing.

11. Termination

These Terms apply until ended by you or us. Your rights under them end automatically if you fail to comply with them. You can end them at any time by deleting the App.

12. Apple App Store terms

These Terms are between you and TechTunerLife LLC only, not Apple Inc. ("Apple"). They supplement Apple's standard Licensed Application End User License Agreement. You and we acknowledge that:

1. Responsibility. TechTunerLife LLC, not Apple, is solely responsible for the App and its content.
2. Maintenance and support. We are solely responsible for providing any maintenance and support for the App. Apple has no obligation to do so.
3. Warranty. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
4. Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App. This includes product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
5. Intellectual property claims. If a third party claims that the App infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
6. Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
7. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the App will be resolved exclusively in the state or federal courts located in New York, and you consent to their jurisdiction. This does not limit any consumer rights you have under the mandatory laws of your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. Changes are posted at this address with a new effective date. If you continue to use the App after changes take effect, you accept the updated Terms.
